While UK employment law does not set a mandatory overtime multiplier, standard industry practice provides 1.25x (time-and-a-quarter), 1.5x (time-and-a-half), or 2.0x (double time for Sundays/Bank Holidays). Effective Hourly Rate = Total Gross Pay (£) ÷ Total Hours Worked (Contracted + Overtime)

Example: Salaried Minimum Wage Violation

A 22-year-old worker on a salary of £26,500/year (£509.62/wk) is contracted for 37.5 hours (£13.59/hr basic). If they work 10 unpaid overtime hours per week (47.5 total hours), their effective rate drops to £10.73/hr.

Result: Illegal underpayment of £1.98 per hour (£94.05/week or £4,890/year) below the £12.71 NLW floor.

1. The 48-Hour Maximum Working Week

Under the Working Time Regulations 1998, workers cannot be forced to work more than an average of 48 hours per week (usually calculated over a rolling 17-week reference period) unless they voluntarily sign an individual opt-out agreement.

2. Daily and Weekly Rest Breaks

Workers are legally entitled to 11 consecutive hours of daily rest between working shifts, 24 uninterrupted hours of weekly rest (or 48 hours fortnightly), and an uninterrupted 20-minute rest break during any shift exceeding 6 hours.

3. Overtime Inclusion in Statutory Holiday Pay

Following UK landmark rulings, statutory holiday pay for the first 4 weeks (20 days) of annual leave must reflect normal remuneration, including regular, non-guaranteed overtime.
